<p>Minutes were approved for the previous meeting with no changes</p>
<p>The Selectmen voted for a new Chairman &#8211; Ron Patch nominated Bob Frizzell and they voted with Bob abstaining, electing Bob Frizzell Chairman for 2011-2012.</p>
<p>There was question over the time being on the agenda for opening the mowing and paving bids.. mowing 6:45pm and paving at 7:00pm. Selectmen Cole said he thought times were not going to be on the bid openings so they waited a bit and asked Chris Gilpatrick what he wanted since they had much time to wait.</p>
<p>Chris Gilpatrick explained he wanted his information. Cole said they were within the 5 days as required by law and they had many boxes to go through to get the info. Gilpatrick explained the request was received by the town 2/ 1/2 weeks ago by certified mail. Selectmen explained they had much going trying to run the town and close the year. Thay had been working on Town Manager stuff and Insurance renewal. Inferring Gilpatrick&#8217;s request is not a priority. Gilpatrick asked when they pay the bill don&#8217;t they have to check it against the contract? They said they do, but it simply will take some time.</p>
<p>Mowing bids were opened after a short delay &#8211; 2 bids were received..</p>
<p>Russell Howard (Rochester) &#8211; $140 per Mile or $55 per hr</p>
<p>C&amp;R Trucking (Lebanon) &#8211; $ 182.50 per mile or $85 per hr</p>
<p>Paving Bids were opened immediately following the mowing</p>
<p>5 Bids were received</p>
<p>Brock Industries (Dracut) $75.40 ton machine &#8211; $110 per ton for hand</p>
<p>Pike Industries (Lewiston) $75.00 ton machine &#8211; $125 per ton for hand</p>
<p>Libby Scott (Wells) $ 71.60 ton machine &#8211; $115  per ton hand</p>
<p>FR Carrol of (Limerick) $63.70 per ton &#8211; All work? No Hand Specified.</p>
<p>RD Torno  (Lebanon) $63.98 ton machine &#8211; $125 per ton hand</p>
<p>Bids will be reviewed and awarded June 21st Selectmen&#8217;s meeting.</p>
<p>Meeting adjourned approx 6:48pm</p>
<p>Upon leaving I did see many of the paving contractors arriving.. obviously expecting the bids to be opened at 7pm as stated.</p>

<p>Meeting opened with pledge of Allegiance</p>
<p>Selectmen Signed a warrant for the School Ballot on December 7th.</p>
<p>Missy Labbe with Ecomaine was introduced and presented information on Single Stream recycling. Her presentation consisted of <a title="Who is Ecomaine presentation" href="http://ourvoice.stadig.org/docs/ecomaine.pdf" target="_blank">Powerpoint Slideshow</a> and a <a title="Ecomaine Process" href="http://www.ecomaine.org/singlesort.wmv " target="_blank">short movie</a> of the Ecomaine facility and their sorting facility. It concluded with a Q &amp; A session.<span id="more-3107"></span></p>
<p>A brief overview..<br />
Selectmen invited Ecomaine to come and provide information on how single stream recycling works and how it could save Lebanon money. Single stream recycling basically means residents would not have to sort recyclables as they do today to glass, plastic, cardboard and paper. All recyclables are commingled and tossed into the same container which would be compacted at the Transfer Station and sorted by Ecomaine, at the Ecomaine facility.<br />
This process according to Ecomaine<!--more--> would reduce the number of trips to haul the waste due to the compacting and it will encourage a higher recycle rate which means less tonnage of regular waste. There are several rate plans and agreements available and all are standardized. The Ecomaine option at a minimum would require purchase of a compactor since Waste Management would not allow us to use one of the two we have for the purpose.<br />
There are a lot of options and Ecomaine will assist with any cost studies the Selectmen would like to perform. It is very early in process but the presentation is very informative and I recommended everyone take the time and view it.</p>
<p>After the presentation Seelctmen opened the floor for public participation&#8230;</p>
<p>Town Clerk Laura Bragg mentioned she had received several inquiries about the <a href="http://www.anhourformyneighbor.com/file/Home.html">&#8220;An Hour for your Neighbor&#8221;</a> program started in many surrounding towns. Basically people can donate to a fuel fund to help your neighbor. Selectmen seemed warm to the idea, so look for more info to be released.</p>
<p>Mrs. Bragg also asked if the Selectmen would consider a &#8220;Tax Club&#8221; for people to pay there taxes in monthly installments. She explained that Berwick had implemented such a plan and it has been very successful. Generic coupon booklets for the purpose would cost $450 for 500 booklets and people simply pay their tax payment each month. Your taxes need to be current to get onto the program and there is no discount. The &#8220;Tax Club&#8221; just makes it easier for people who don&#8217;t escrow property taxes and provides another option to residents. To implement the program it would require a positive vote by the residents in June.</p>
<p>Mrs Bragg also asked Selectmen if the Town Vote would be the 2nd Tuesday in June as usual, Selectmen said yes.</p>
<p>The new Library under construction is 90 percent complete and is on budget. Selectmen anticipate it opening mid-December.</p>
<p>Selectmen have mailed a survey / newsletter to residents that should be received today. They ask to please return the survey since the information is an important tool in their training.</p>
<p>Resident Glen Stadig asked if the policy for the Transfer Station and Commercial Haulers has been completed it was in process most of the year. Chairman Cole said they had asked the Town Manger for Berwick what, Berwick would do?  Berwick stated if they were not pay for bag that they would allow commercial haulers. When asked what towns in the local area Selectmen had spoken to who DID ALLOW Commercial Haulers? Mr Cole responded, NONE that they were aware of but Ecomaine does have towns in there service area that allow them. Mr. Stadig clarified that Ecomaine services communities up north. Chairman Cole did explain that the commercial hauler is no longer allowed a key to the facility for access anytime.</p>
<p>Mr Stadig also asked about a staffing change at the Transfer Station that was not posted and involved the hiring of Selectmen /Department Head Ronal Patch&#8217;s brother?   Chairman Cole explained if a Department Head knows of a qualified, experienced person for a position they have latitude to hire them.  Mr. Stadig&#8217;s concern revolved around the fact that Mr. Patch has hired his wife and now his brother to his Department and this represented to much control. The immediate Patch family now constitutes a majority of employees at the town facility this is a liability. Further posting the position gives other people an opportunity to get a more qualified person for the position. Selectmen Patch explained that experience and qualifications were not needed for the position.</p>
<p>Chairman Cole thanked the Veteran&#8217;s for their ceremony last week, and said the Veteran&#8217;s Hunter&#8217;s Breakfasts and Suppers have been very successful with fund raising. He also thanked the Rescue volunteers for their hard work and their award from the state.</p>
<p>Chairman Cole also explained the enforcement of the out of state registrations was going well and they have some 250 vehicles identified and photographed. Sheriff Deputies and a Special State Investigator will be commencing with summonses soon.</p>

			<content:encoded><![CDATA[<p>I received an email from resident Chris Gilpatrick this afternoon saying he had called the Town Hall and spoke with the Selectmen Secretary. He was inquiring if a meeting was being held this evening and the answer he received was YES there would be a meeting<span id="more-2963"></span> at 6:30pm. I was shocked, there had been no listing of the meeting in the Town Calendar only listings of the Tuesday workshops, town holidays and other Selectmen Meetings later in the month. I wrote the Selectmen an email immediately stating I did not believe proper public notice was given and that the meeting should be re-scheduled since it was not officially and or properly posted.</p>
<p>I arrived at the Town Hall at 6:25pm to see a hand written notice on the door stating there would be a Selectmen Workshop Wednesday morning at 9:30am. There was a similar notice in the posting area outside. There was also No notice of cancellation for the non-scheduled meeting and no official people around.</p>

<p>I returned home and went to the Facebook and saw a posting at 7pm stating a Special Selectmen Meeting was to be held on Wednesday morning at 9:30am. I ask you is 14 1/2 hours of notice via a post on a Social networking website reasonable notice for a meeting? Shouldn&#8217;t all official meetings be posted on the Town Website with a minimum of 24 hours ( in extreme emergency situations).</p>
<p>The Right-To-Know law says something like reasonable public notice which leaves things a bit open to interpretation. I don&#8217;t believe the expectation of the Law is that Town Residents are expected to drive by the Town Hall daily to see if a meeting is posted on the door or outside cabinet. I don&#8217;t understand why a meeting can&#8217;t be properly called with reasonable proper public notice.</p>

<p>If the original meeting was missed in error o.k. re-schedule for later in the week at night, post it on the website and shoot it to the papers. Give residents a reasonable couple days notice. Why does something so simple seem to be so hard? This is not an emergency..If it does have time pressure why not do it at the last meeting?</p>
<p>On the Town Hall door the meeting is posted as a Workshop, but on Facebook it says Special Selectmen Meeting&#8230; It would seem to me election of a New Chairperson is an official meeting and should be posted that way, not as a Workshop, it is all misleading. Combine the misleading with the short notice and it all just seems wrong.</p>
<p>I think the recent initiatives by the Town to use Facebook and alternate media channels is  great&#8230;However, there is also an excellent email posting systems already employed by the town for notifying people directly of public notices just like this meeting, why not use them?</p>
<p>Not everyone uses Facebook even for those that do, 14 1/2 hours  is simply not enough notice in my opinion and falls well short of the intent of the Law.</p>

Discussion about changing phone number for town hall back to 457 instead of 608.  A company out of Kennebunk asking for copy of contract with waste management for dump. Much discussion before reluctantly agreeing to allowing this.</p>
<p>Town Clerk  Laura Bragg looking to go over gen.government budget with Selectmen and employees at town hall. budget$2900.00 less than last year as it is. Discussed date for public hearing. Charter question to be on ballot for June. Charter members to be elected in november if referendum passes in june.</p>

<p>Selectmen Chair Bob Frizzell, Selectmen Jason Cole, Selectmen Ronal Patch</p>
<p>arrived at 8:55am meeting was already in session. Town warrants all signed. Selectmen went in executive session for personel matter at 9:00am and were done at 9:05am, Selectmen  stayed in<span id="more-2361"></span> executive session with Fire Chief Skip Wood from 9:05 until 9:42am.</p>
<p>Selectmen Secretary Sue Collins talked about tax issues with east Lebanon auto sales. possibly totaling $16-17,000. Zeke called in to discuss other matters about this business including contaminated soil and no septic system (possible illegal system) for garage part. A new system being installed but legal matters still ongoing.</p>
<p>Brief from town Attorney Alan Shepard on a court case involving Ron Wright from Indian Lake Shores over illegal cutting of trees by water. Landowner lost case in court and is possibly appealing decision. Tree cutter cleared by town from charges by helping town against resident. Selectmen Patch said $5,000 fine to wright.</p>
<p>Discussion with Town Clerk Laura Bragg on closure of part of Upper Barley Road. Road closed in 1938 by town vote but town attorney to decifer terms of vote. A court case is pending on matter. judge waiting on decision.</p>
<p>Selectmen Secretary Sue Collins provided budgets for 9-1-1, EMA, and Library. She made copies for selectmen and plan is to be discussed at next weeks selectmen meeting.</p>
<p>Excise Tax Collector Christine Torno spoke about about copiers. No contact provided from Steve Endsley.  Mrs Torno bought another copier and is waiting to see what Steve Endsley will  do with old ones.  Mrs. Torno also talked about buying laminating machine to make revenue.</p>

			<content:encoded><![CDATA[<p>It is troubling to me that the Selectmen have started having Selectmen Meetings during the day, without having a secretary present maintaining minutes. If you look at the daytime meeting recordings, the meetings have no secretary, are not formally opened or closed, and they go into executive session. <span id="more-2325"></span></p>
<p>In review of the previous meeting, Mr. Gilpatrick had asked why the town calendar was changed to show &#8220;Meeting&#8221; versus &#8220;Workshop&#8221; and it was explained this was done in the event they wish to vote and transact business they could. I understand the desire to have flexibility, but his isn&#8217;t the way that business should be done.  Business should be done in the evening only, as is customary.</p>
<p>If you look at the last couple of daytime meetings you will see much of what you would expect discussed in a normal evening meeting which is not. The evening meetings end up having no agenda, are routinely canceled, The last evening meeting would have been 10 minutes had residents not had questions. Is it me or is this all backwards?</p>
<p>There is a clear reason for NOT allowing such flexibility with voting and requiring proper meeting notices and published agendas. Declaring anytime as meeting notice isn&#8217;t acceptable in my opinion and proper records must be maintained.</p>

<p>Selectmen Present &#8211; Mr. Frizzell, Mr Cole, Mr. Patch &#8211; Meeting Length approximately 50 minutes</p>
<ul>
<li>A moment of silence was observed for the passing of Mr. Potter and Mr. Wyman.</li>
<li>The Shoreland Zoning Map had errors. These have been corrected, but the matter must come back before the voters in June for approval.</li>
<li>Charter Petition votes are being certified by the Town Clerk, she also noted that a Recall ordinance does not require a Town Charter to be implemented and adopted.</li>
<li>A Special Agent has been assigned by the State / County to aggressively work with border towns like Lebanon to gain compliance with the registration of autos, boats and the like. There have been several articles in the papers indicating steep fines being levied by the State for failure to follow the State laws and comply.</li>
<li>Tentative Budget deadlines were set as Jan, 7th 2010 with a department head meeting being held on 12/15/09 at 6:45 at the Town Hall.</li>
<li>Fire Truck repairs were made from the Fire Department budget. Chairman Frizzell made note that Selectmen were aware.</li>
<li>The Tax Collector Laura Bragg had a question on the Conflict of Interest Policy in terms of abstaining and recusal. Could a person with an obvious conflict participate in discussion as in the case of the Budget Committee as long as they didn&#8217;t vote? Mr. Cole explained that yes they could participate in discussion but not be able vote.</li>
<li>Chris Gilpatrick asked if the Selectmen had received the names from the Town Attorney of people contacted over his request for information. No response was forthcoming for some time, Chris supposed he would have to have his attorney get the info&#8230;Chairman Frizzell thought that would be a good idea.</li>
<li>Chris Gilpatrick asked Selectmen if he could get a key to the Transfer Station?  He detailed how on election day, he observed Mr. Hartford access the facility and dump materials when the facility is closed. This further expanded into a question of liability for the Town having this person accessing after hours, and alone in the event of injury. There was also concern of control over what was being dumped, and how to be sure where the waste was coming from.  Chairman Frizzell stated Mr. Hartford provides a service to residents and all residents have the right to have there waste placed in the facility. The issue though is not the residents right of access since all residents have this,  the issue is Mr. Hartford being a for profit business using a town facility, and having free unfettered access to the same. If Mr. Hartford chooses to provide the service,  this waste should go directly to the local waste facility not the Town facility. Chris Gilpatrick stated that at a Budget Committee meeting a while back a representative from the waste management company had indicated the quantity of waste sent to their facility by the town was very high compared to other towns and our towns population. This additional waste costs ALL taxpayers money and is the primary reason to enforce the permit policy and a keep ALL commercial endeavors out of the Town&#8217;s Facility.</li>
<li>Selectmen went into executive session for approximately 10 minutes</li>
<li>Upon return Selectmen stated they would take the matter under advisement and adjourned the meeting.</li>
<li>Of course there was more&#8230;.</li>

			<content:encoded><![CDATA[<p>Meeting Highlights:</p>
<p>A land trust appeared before the board to inform them they were a 501c and tax exempt trust. They had been donated 10 acres along the Salmon Falls River and would like to allow public access . This access would be in the form of a walking or X/C ski trail, not camping. <span id="more-2062"></span>The trust wanted the Selectmen and the Town to understand that by State Law they are tax exempt and are required to pay nothing. Working from this stand point the trust would like to &#8220;donate&#8221; to the town monies as a good neighbor.</p>
<p>Chris Gilpatrick had made request to the Selectmen through the freedom of information act. The request was for three items</p>
<ol>
<li>A copy of ALL time-slips turned in for mowing town owned property; town hall, dump, old town hall. etc&#8230;.</li>
<li>A copy of ALL invoices submitted by Alan Shepard or Shepard and Read for Chris Gilpatrick request of job employment and budget committee position of Lorraine Patch.</li>
<li>A copy of ALL Correspondences by Alan Shepard during his research on the Lorraine Patch issue. Notes, e-mails, etc</li>
</ol>
<p>Mr. Gilpatrick explained what he received on items 2 &amp; 3 were lacking in detail. Mr. Gilpatrick stated he expected to see contacts, and correspondence and other information indicating an investigation, Instead he only saw a summary for hours billed by the attorney. Selectmen Patch explained that there was nothing to review and the matter should be dropped.  Mr. Gilpatrick believes nothing was ever done with his original request other than a phone call to the attorney and he want this matter addressed properly.</p>
<p>Discussion was had on stickers being used at the transfer station and how the policy of the town should be enforced. Lack of enforcement costs all of the residents money since we pay to haul all the waste away. Further discussion was had on what waste generates revenue for the town such as cardboard, and metal and how people are NOT allowed to pick through bins.  As an example people cannot go through a pick copper out, they can&#8217;t pick anything. This is dangerous and once items are in the bins actually become revenue to the town. Glen Stadig made the point a small area would be beneficial to allow residents the opportunity to set items a side where people can pick-up items. This could reduce waste, and extend the life of some good items. This might be considered.</p>

			<content:encoded><![CDATA[<p>A reminder the regular Selectmen meeting is tonight at 6:30pm. I have requested to be placed on the Agenda and have been scheduled for 7:30pm.  My topic in question is the uncertainty that has been published about November ballot in particular the CEO budget, as well as Town Manager Plan and Ambulance Petitions. I encourage all residents to attend<span id="more-1908"></span> to show support for the ballot and the revisiting of these items in November.<br />
It could be there was a misunderstanding with the Newspaper article and comments printed, or then again it could be and more likely is, a serious problem with our Towns administration. We will learn tonight&#8230;come on down.     <em>Note: The town published an agenda I have placed it below. The 7pm item I think is in accurate and should be &#8220;award winter sand bids&#8221; since they were opened at the last regular meeting. The times are approximate so best to be early in the event things move quicker.</em></p>

<li>Meeting Started about 10 minutes late with Selectmen Patch and Selectmen Chair Frizzell (Selectmen Cole was Absent)</li>
<li>The paperwork for  Deputy Officers for Tax Clerk, Excise Clerk etc were signed.</li>
<li>Treasurers Disbursement Warrant was signed &#8211; Allows 1 Selectmen to sign and disperse payroll to town employees.</li>
<li>Starting 7/2/09, the Town Hall will be opening Thursday  evenings until 7pm, opening later at 9am on this day. There are several dates during the year where conflicts are known and these will be scheduled to have an alternate day when necessary providing plenty of notice to residents.</li>
<li>A Memorial for former Selectmen and Plumbing Inspector Gil Zinck was discussed. Instead of using a wooden bench with a plaque, a granite bench with engraving is favored. The bench itself was estimated at being a $200 from Roy Monuments. Engraving will be extra and no estimate was provided, it was requested that this work be placed out for public bid.</li>
<li>A Storage shed used for older Selectmen records has a failing floor and is getting tight on space. Several old desks are stored which can be tossed. Selectmen are favoring the construction of a new building. When questioned they did state they would place this structure out for public bid. More importantly the contents of the shed need to be gone through and essential records kept and the trash tossed.   I suggested evaluating a software such as &#8220;Kwik Tag&#8221; to electronically archive documents that saves the space, makes them secure, and allows instant retrieval. It works with live documents like word, excel and pdf as well as scanned documents. Further the documents are safe from fire, theft, and harm. This method is used by legal firms, hospitals, FDA regulated companies etc. It is a known secure method of managing records.</li>
<li>Selectmen will continue the first and third Tuesdays as being their normal meeting days. The website will be updated to reflect the schedule and time.</li>
<li>Planning Board has not met the last two months due to not enough people to facilitate a quorum. If you have time to volunteer please contact the town hall.</li>
<li>A State referendum vote will be occurring in on 11/3/09.  The Town Clerk informed Selectmen if they chose to place a town referendum on a ballot, they need to have it to her by 9/1/09 to be included, for example the CEO budget could be revisited at this time.  I questioned if residents would also have the opportunity to have an item placed on this ballot and was told it would be to the Selectman&#8217;s discretion since there is a cost. Technically residents could have to wait until the regular June meeting.</li>
<li>The meeting on the implementation of the Transfer Station stickers has not occurred yet. It has been nearly 6 weeks since the plan was announced and materials have been available.</li>
<li>Kim Anderson has resigned as the Town Librarian no reason was provided.</li>
<li> I asked why going forward if the town knows the expenses from the Budget Process and knows the School Budget why they couldn&#8217;t provide an estimate to residents on the effect to our tax bills or mill rate? As an Example, If residents had known if they voted yes to everything asked for on the referendums, and the tax effect would be little to no change, it could have impacted the vote. They said they would look into it and see what could be done, the calculation was involved.</li>
<li>Budget Committee write-ins were Mark Stuart and Judy Churchard. Selectmen were provided the names of the remaining runners-up for selection of alternates to the Budget Committee.</li>

<ul>
<li>Rescue Chief, Samantha Cole, The Rescue Department received a grant for a new 2009 Ford Expedition XLT  from the Stephen and Tabitha King Foundation. The grant covers the full cost for the vehicle<span id="more-1430"></span> and a little bit extra for some equipment for it. The grant was for $30,000 and the vehicle was like $29,000. It should be delivered this week or next week. The current vehicle will remain in service. &#8211; Thank You Mr King!!</li>
<li>Selectmen said details are still being worked out for the potential moving of the Town Library to Hanson School. This seems like a good idea allowing residents greater access to the Library year round. It could also bring more access to State grant monies with the year round service.  Many questions remain over space, access to the schools other areas and ongoing funding when the grant monies run out. More details will likely be coming as the Selectmen review the matter further.</li>
<li>Town Clerk, Laura Bragg said that 105 absentee ballots have been issued, which is low.  The turnout for the school vote a couple weeks ago was also low so perhaps it&#8217;s a sign of the times. Second grade classes from the elementary school will be doing a field trip to the town hall. She conducted measurements to ensure the political signs at the corner are more than 250&#8242; from the Town Hall. She reminded everyone the Town Office will be closed next Tuesday for the election, polls will be open 6Am-8pm.</li>
<li>Excise Tax Collector, Christine Torno explained concerns over the upcoming excise tax article on the State ballot. It sounds good to lower excise taxes but in effect if this is adopted property taxes will likely increase. Today, if a person buys a new vehicle they pay more excise tax, as a vehicle gets older it gets cheaper. If the new state item passes this won&#8217;t be the case.</li>
<li>Transfer Station, Ronal Patch explained they had received roughly $1500 from iron being picked-up. The company that removes freon from old refrigerators and freezers has dropped their fee from $15 down to $10. Mr. Patch has decided that he will lower the fee charged residents from $15 to $10 beginning the new year. Selectmen Churchard gave Mr. Patch an award for manager of the year.  Implementation of the new Transfer Station stickers is nearly complete and final details will be worked later this week.</li>
<li>Jessica Brewington was introduced as the new Recreation Director and has been busy. She has located loads of donated of clothing and bedding that will be available at the church hopefully by July. She is also anticipating an article being placed in the paper for a walkathon and has been busy working with Christine Torno on the handing off of duties.</li>
<li>Road Commissioner, Ray Davis stated the Brush Clean-up Project was underway for the third day and that road patching was also being worked on. The Fire Pond adjacent to the Town Hall has been completed. Selectmen Frizzell asked if any patching had been done on Lower Barley Road, Mr. Davis did not know.</li>
<li>Fire Chief, Skip Wood spoke of the need to get some of the required NIMS training completed. NIMS is a standard common terminology used during emergencies by the government. Mr. Wood also said they had tested the current capacity of the new fire pond and they had roughly 70,000 gallons of water. He said provided the current amount holds throughout the summer it should be fine.</li>
<li>Code Enforcement Officer, Brian Rainaud stated that overall permits and inspections are down although they have still been struggling with many compliance issues. A particular problem is business off Creamery Road that has some 500 vehicles and is operating under a recyclers license.</li>
<li>EMA, Tom Cravens said things were good in the EMA world and that he was working on upgrading his Training to meet the new state guidelines.</li>
<li>Resident Noreen Bridges spoke to Selectmen on the horrid conditions of Keay Road. She has brought this to Road Commissioner Davis several times over the past four years and nothing is being done as it continues to degrade. Mr. Davis had left the meeting so he was unable to address Mrs. Bridges in person. Christine Torno lives on this road and concurred the crown on center of the road is nearly impassable for normal cars and that was on the &#8220;smooth&#8221; part. Selectmen explained they would look into it and took Mrs. Bridges contact information.</li>
<li>Residents of Bog Road spoke requesting a reversal to the decision to discontinue the last portion of the road. They explained the evidence supporting the decision was unclear, the road has been town maintained for 71 years, and a large portion of residents live on the last few hundred feet of this road. Selectmen said they were sorry and were simply following the law, and recommended the residents contact Pine Tree Legal services.</li>
<li>Resident Chris Gilpatrick stated he observed the Brush Clean-up Project underway and five or so people were working and nobody was wearing Hard Hats, Ear Protection, or Eye Protection. Safety equipment and personal protective equipment besides being mandated by O.S.H.A was also a major portion of the bid specification for the work. Selectmen Churchard said she was aware of it and were looking into the Safety problem that day.    Mr. Gilpatrick also spoke in support of the Bog Road residents and stated that plowing and maintenance by the town of parking lots and other non town areas like the Post Office are done routinely and have been for some time.</li>

<li>Selectmen read and signed a proclamation making this week National Emergency Medical Services Week May 17th-23rd 2009<span id="more-1380"></span></li>
<li>Bob Frizzel was nominated to be Chairperson by Selectperson Churchard, vote passed unanimously.</li>
<li>No Bids were received for the brush clean-up project, therefore the Town will do the work. FEMA has allowed about $13,500 for the work and the same people who originally bid the work will be doing the work. The bid request made the papers on Friday of last week, but it was also posted on the MMA website and Town Website for vendors to bid.</li>
<li>F.R  Carrol won the bid for paving for this coming year.</li>
<li>Boucher Construction was the only bidder for roadside mowing and won the work. It has been stipulated the Mowing is not to begin until brush clean-up work is completed.</li>
<li>Bog Road was discussed &#8211; The Town did grade the road all the way up, as always done, a couple weeks ago. The maintenance and plowing will end .35 of a mile up road going forward since the balance of the road has been deemed private.</li>
<li>Dan Stuart came to the Selectmen regarding a drainage issue he believes is caused by his neighbor and requested Selectmen take action. Selectmen declined the request since this is a private matter. The situation was looked into and Fire and Emergency equipment may pass. He was  encouraged to enlist the help of his neighbors and speaking to the resident as a group or to contact Pine Tree Legal for help in getting action on the civil matter.</li>
<li>Attorney Glen Foy came to have paperwork re-signed for the sale of the old town hall. The original paperwork was not notarized as required. Selectmen Churchard requested the sign from the old building be returned to the town for placement inside the new town hall. The attorney also mentioned files were still in storage at the building requiring removal.</li>
<li>Residents are reminded that there will be services at the Old Old Town Hall on Center Road Monday at 2pm. Contact the Town for Details.</li>

<p>I arrived at 6:24 for the meeting that was posted on the Town website as starting at 7pm. I had observed earlier in the day on the Town website mowing bids were to be opened at 6:45pm so I assumed the meeting might be at 6:45pm. I was wrong..It evidently started at 6:15pm<span id="more-1292"></span> and went to executive session which is where the recording picks-up as the Selectmen return at appx. 6:42pm.</p>
<ul>
<li>One bid was received for roadside mowing by Boucher Construction. Bid was for $160 per mile, Selectmen Frizzell believed last years rate was $150 per mile.</li>
<li>Southern Maine ATV presented selectmen with materials to review regarding a municipal grant for a trail project and license with Central Maine Power. They are applying for grants totaling and estimated $225,000.</li>
<li>Selectmen opened and read bids received for paving. The bids will be awarded at the next meeting in two weeks.</li>
<li>Laura Bragg asked if Selectmen would like letters for appointed positions as is usually done? The Selectmen said yes to provide letters.</li>
<li>Selectmen reviewed and signed the Shoreland Zoning paperwork and Warrant changes and filing for the State of Maine.</li>
<li>Selectmen are looking into conflict of interest issues raised over a Department Head potentially also being a Selectmen with the Town Attorney. A letter is expected soon but it likely won&#8217;t be definitive.</li>
<li>The Selectmen were questioned about the status of the Brush Chipping Project from the last meeting.  Selectmen decided the project would be performed by the Town. FEMA has approved the town do the work with a not to exceed price of $11,000 according to Selectmen Frizzell. Selectmen were questioned by a resident as to why this project did not go out for public bid since having the Town do the work essentially left it to the same people who internally (closed) bid the work. The lowest bid received at the previous Selectmen Meeting was $9,500o.  Selectmen were also questioned about the fact that a long standing referendum required all work over $10,000 to go out for public bid. The validity of the referendum was questioned by Selectmen. After some discussion, Selectmen Cole made a motion that a bid request be published in the papers and the sealed bids reviewed at the next meeting. This was seconded by Selectmen Churchard with Selectmen Frizzell voting against. Selectmen Cole requested a copy of the bid spec from Road Commissioner Davis as used for the previous bid and was informed there was none and that the project encompassed all roads in town (est. 80-90 miles).</li>
<li>Road Commissioner Davis stated a resident had requested permission to plank a section of the Old Bridge on Upper Middle Road. Selectmen had no issue with the residents attempting to improve the bridge for ATV use. Selectmen Cole requested the &#8220;Dead End&#8221; sign on the rt202 side be moved to clearly indicate the roads status.</li>

			<content:encoded><![CDATA[<p>Meeting Highlights:</p>
<ul>
<li>Sealed bids were opened and announced for clean-up of brush along the Town roads resulting from the ice storm this past winter.</li>
<li>The clean-up work was NOT placed out for Public Bid but was circulated internally. It was explained when asked, that there was a desire to have a resident do the work versus an outsider. (The work should still be placed out for bid to ALL residents, giving ALL residents the opportunity)<span id="more-1167"></span></li>
<li> There were four bids received to do the cleanup Phillip Newton $11,00o, Josh Boucher $12,000, Steve Newton $11,420, and Roger Gilpatrick $9,500 ( I apologize if the names are not accurate or misspelled it was hard to hear)</li>
<li>A FEMA representative had toured the damage with Mr. Davis and concluded about $14,000 in FEMA funds would be available to have the clean-up work performed.</li>
<li>Selectmen did not act to accept the bids for the clean-up work and postponed taking any action.</li>
<li>Rapid Renewal will start the processing of Boat registrations. This will expand the easy online service for residents starting May 1st.</li>
<li>A Department Head has submitted paperwork for candidate as Selectmen. Concerns were raised over conflict of interest since the person is a Department Head and receives a Town wage and also oversees other Town Employees in his normal function. This situation is not exactly the same as Selectmen Cole who is an officer on a volunteer squad. The Selectmen will investigate to determine if this is appropriate.</li>
<li>Selectmen adopted a policy for use of permits at the Transfer Station, an alternate color will be used for seasonal residents as well as a colored card. The Transfer Station will still need to enforce the usage.</li>
<li>The open Town style meeting at Noble High School to review and workout the School Budget will be May 7th at 6:30pm with the vote being held May 12th at 7pm. Residents are encouraged to attend and participate.</li>
<li>A Public Hearing was held to answer questions and adopt the Shoreland Zoning ordinance as required by the State.</li>
<li>Progress has been made on loading Budget Numbers into the Town Accounting System. This should make reporting much better.</li>

<ul>
<li>Selectmen review minor changes in the personnel policy.</li>
<li>A vote was taken on the discontinuance of a portion of Old Center Road. It passed unanimously to be closed and an article will be presented to the public to vote on to accept in June.<span id="more-1075"></span></li>
<li>The <a title="Lebanon Maine Ethics / Conflict of Interest Policy" href="http://ourvoice.stadig.org/docs/ethicspolicy20090407.pdf" target="_blank">Conflict of Interest / Ethics Policy</a> was reviewed and voted into effect starting 04/07/09. There was some public discussion as to the timing of the policy&#8217;s implementation and concerns over equal application to ALL departments, boards, officers and committees. It was explained the policy has been in effect informally for some time and that it simply defines things in more certain terms and also provides a process for the public to bring issues forward to hearing.  The policy is also based upon elements of municipalities of about the same size and nature as Lebanon. <a title="Lebanon Maine Ethics / Conflict of Interest Policy" href="http://ourvoice.stadig.org/docs/ethicspolicy20090407.pdf" target="_blank">A copy of the policy may be viewed here</a></li>
<li>Superintendent of MSAD#60 Paul Andrade presented the preliminary school budget for 2009-10. The budget highlights a cut of $484,421 in total which amounts to Lebanon&#8217;s share of expenses reducing by $221,670. Although preliminary this was welcome news as well as the indication there is potential for some additional cuts.  (please see <a href="http://ourvoice.stadig.org/2009/04/08/lebanon-school-budget-cuts-projected-at-221670/" target="_blank">Audio and Video</a> excepts for details on how budget was changed)</li>
<li>Superintendent Andrade also suggested exploring working with the Town to open the Hanson School library evenings and perhaps combining collections with the Town Library to expand services to residents.</li>
<li>The wording of Warrant Articles have been completed except for Transfer Station and Code Enforcement Officer (CEO) they will be presented to the Budget Committee for review tomorrow night. The Selectmen also stated that they will be mailing a sample ballot out to residents explaining what each of the articles are and any impact they may have. There would be no Selectmen or Budget Committee recommendation on this mailing. It is simply going to be an informational piece to help residents be better informed.</li>
<li>Residents are needed to fill available positions. Papers have been taken out by by one candidate for Selectmen and two candidates for Budget Committee. We need more residents to get involved in helping the town. Please consider pulling papers and helping as Selectmen, Budget Committee, Rec Dept Head, Planning Board etc.</li>
<li>Tax abatement&#8217;s reviewed and signed.</li>
<li>Laura Bragg requested having the parking lot at the Town Hall swept of sand. They considered renting equipment but found a person who would do it for $100. The Selectmen authorized her to proceed.</li>

<p>Meeting Highlights&#8230;..</p>
<ul>
<li>The generator requirements for the Town Hall have been identified and Selectmen Cole has been checking equipment costs to determine estimated costs for budgeting. The purchase and installation of the new fixed generator will be posted for Public Bid soon.<span id="more-1004"></span></li>
<li>The Selectmen have tentatively approved the hiring of a full-time Sheriff Deputy for the next 3 years. This new Deputy would work solely in town and will be in addition to the normal Sheriff&#8217;s coverage we have today from the county. The new position will allow for a focus on enforcement of vehicle registrations, codes enforcement, and other town issues as well as normal coverage. The cost to the Town of the Deputy is about $18,000 per year with the county paying any additional expenses. When the three year period ends so does the position. This will be placed on the ballot for vote and final approval by residents this June.</li>
<li>Rates for plowing will be increased about $3 per hour for plowing. This was done as an offset to a policy change not to provide plow edges to the sub contractors. Since the budget was for like 12k in plow edges and this rate increase equals about 5k, the increased is being explained as savings of 7k. Clearly this is not entirely accurate since the 12k budget item has been denied by the budget committee.</li>
<li>Political Activities of Town Employees was discussed and the town policy was read aloud. Although no names were provided it was explained a town employee  is using their position and contact with people to stump for office in town which is NOT allowed and is a problem. Selectmen stated they will place a copy of the policy in all Town Employee in-boxes in hopes it will stop the wrongful conduct.</li>
<li>Kevin Hartford requested the Selectmen reconsider closing of the Transfer Station on Tuesdays. He runs a business where he picks up residents rubbish and takes it to the Transfer Station for a fee, closing would cause him hardship. He further explained he used to run his route on Saturdays, but changed after 13 years to Tuesdays at the request of Selectmen to cause less disruption. Ronald Patch offered that Mr. Hartford could be provided a gate key to continue Tuesday access on his own provided he keep the gate closed and he operates the compactor to &#8220;Run-It-In&#8221;.  Mr. Patch also stated Mr. Hartford separates the recyclables.</li>
<li>Ronald Patch asked Selectmen if he could open the Transfer Station one hour earlier two or three days a week. He explained it was difficult to split his peoples hours for their daily shifts at 4 1/2 hrs where 5 hrs would be so much easier. He explained it would also provide greater convenience of access to residents. Selectmen explained the purpose of closing a day is to cut hours and reduce the budget. Mr. Patch stated he really wanted to add the hour as requested and if he came up short in the budget, his department would just make due light a person or two if needed. Mr. Patch further explained how a &#8220;Bridge Account&#8221; was used when he was Selectmen to maintain 5k per year for bridge repair, but would also be used for budget shortfall. Jason said they do maintain a bridge account today and keep 50k in there. The Selectmen will review the budget and see what they can do.</li>
<li>Transfer Station permit issuing methods, management and enforcement were reviewed. Several options were discussed but no clear enforceable option was selected.</li>
<li> Public Hearing on discontinuance of Old Center Road as a Town Road was held. The road is about 600 feet or so. The resident who lives on the road was present and expressed concern he could be blocked out of his property and was worried about liability. Selectmen explained the road today would be become and easement to abutters of the property and would be maintained by same.</li>
<li>The recording of meetings was discussed and Selectmen Churchard explained Selectmen did not have time to write a policy and did not have the couple hundred dollars needed to fund the equipment. Selectmen Cole explained he was familiar with recording as done at other towns and believed a digital recorder was a good idea. Mr. Cole appeared hopeful something could be done and understood the benefits.</li>
<li>The clinics for the towns elderly scheduled to start soon are getting muddied in an application process. Selectmen Churchard is adamant that the fund is not for &#8220;low income only&#8221; residents but all the town elderly. Details are still being worked out and at present it appears the clinic WILL start soon.</li>

<p>Selectmen review student artwork for the Town Report selecting winners.</p>
<p>Selectmen discuss a potential for having a full time Sheriff looking out for the Town</p>
<p>Actions and options are discussed for 274 Old Ledge Road and other properties in town that are in ill repair and out of code.<span id="more-924"></span></p>
<p>Actions and options discussed for homes in foreclosure for years due to non-payment of taxes. Clarification on the process was provided by the Town Attorney.</p>
<p>Chris Gilpatrick questions why he was not placed on the Agenda as requested. He requests his status as a sub-contractor for the Town. When informed he was terminated and no longer would be plowing for the town he questions how decision was made and attempts to plead his case with Ray Davis and Selectmen.</p>

			<content:encoded><![CDATA[<p>Highlights of this weeks meeting:</p>
<ul>
<li>Selectmen review the upcoming budget requirements for Emergency Management.</li>
<li>Residents from Bog Road attend to learn if any new developments occurred regarding the maintenance of their road (no new developments). Original meeting minutes located but need interpretation. The School has been notified to NOT suspend bus service and the contested segment of road is continuing to be plowed.<span id="more-815"></span></li>
<li>Lebanon Rescue subscription status and its corporation discussed in regards to accountability, balance sheet, funds usage. The issue was raised by the Budget Committee and selectmen were following up. Jason explained Rescue believes in full disclosure, and every penny in and out of the subscription fund is viewable online, by anyone at the Rescue&#8217;s website.</li>
<li>Names were provided to the Town where plowing of snow into the road had occurred during the recent storm. One of the plow truck operators explained &#8220;the bank was nearly as high as that clock and nearly spun me around because it was frozen in&#8221;.     Hopes are action will be taken on the matter.</li>
<li>No records have been found regarding the indicted town employee. The issue was raised several weeks ago. Selectmen are still searching records and are going to check newspapers.</li>
