			<content:encoded><![CDATA[<p>The Selectmen held a public workshop to explain some of their goals and to solicit ideas and input from residents on what they and we would like to see happen over the next year. This meeting will have a follow-up in a couple months where progress reports<span id="more-3036"></span> and more exchange can occur. One of the overall concepts stressed during the meeting was that improvement in communication needed to occur, both to the public, within departments and inside the town hall itself.</p>
<p>Meeting Highlights:</p>
<p>All Selectmen were in attendance</p>
<p>Here is a list of some of the items suggested by Selectmen and residents during the meeting. Selectmen will be looking in to these in the coming weeks.These are in no particular order of priority, simply a list.</p>
<p>Firetruck Fund to set a side say 50k or so each year towards purchase of a new firetruck.</p>
<p>Improvement of roads by spending much more and planning better. Perhaps implement and use a road review committee formed by volunteer residents as was done with success in the past. Look into cost analysis of outsourcing winter plowing versus homegrown approach.</p>
<p>Formulate a Town manager implementation plan. Meet with area Town Managers to gain insight, learn about contract needs, wording and salary requirements. Perhaps use a sub committee as part of the Selection process. Ideally get a person who will be with the Town for a while by properly matching skills and needs.</p>
<p>Grow the free Health Clinic services and also advertise them better</p>
<p>Institute a volunteer program for the new library and also other activities and programs in town.</p>
<p>Town Website improvements&#8230;notice updates, bid requests and awards, better usage by town departments instead of having all separate websites use a single site.</p>
<p>Quarterly Newsletter published and sent to residents with news, activities and information.</p>
<p>Office manager assigned with communicating vacation requests. internal correspondence and flagging correspondence to correct people.</p>
<p>Legal services usage and questions logged to save redundant information requests within the town hall.</p>
<p>Eco Maine coming in to do presentation opportunity of reducing cost on  Transfer Station waste July 20.  Enforcement of resident permits and elimination of commercial hauler using facility to reduce waste. Better utilization of current services by crushing co-mingles as suggested by Budget Committee.</p>
<p>Town Audit and other professional services placed out for bid. Doing so with insurances and phones has saved tons of money in the recent past.</p>
<p>Look into improving law enforcement in Town. Sheriff has suggested grant money may be available to offer a similar plan as last year providing Lebanon a full-time officer dedicated to our town only. Alternatively look into option of co-op or rental of officer from another neigboring town.</p>
<p>Publish a police log of sorts where information is available even if only total calls so that residents have an idea of the high volume of calls and if possible the type of call. Crime and drugs are a problem in town and residents need to be aware.</p>
<p>Better use of the planning board to review ALL projects in town. Currently a small amount of items get a formal review. Only subdivisions..this might be able to be changed with an ordinance.</p>
<p>Comprehensive Plan committee formed for purposes of preparing a Comprehensive Plan for the Town. This would be done by volunteers maybe a dozen or so. The plan was done a few years ago but required funding for the required maps. The funding did not get approved. Selectmen said we lose so much in the way of State Funds and Grants because we lack any formal plan. The old work could be used along with present state templates to prepare a plan quickly. This would all need public review and be voted to be adopted once completed. A Comprehensive Plan focuses on Zoning and develop areas and provides a growth plan or road map for the town.</p>
<p>Budget items presented in a standardized format and also available early in the process to the Budget Committee for proper review.</p>
<p>Record all the meetings, Selectmen, Planning Board etc via video and place online. Do this in a way that residents may access any of them on demand as other towns do. Also get cable provider to present them on TV so residents to stay informed.</p>
<p>Perform formal performance reviews of town staff. This has not been done routinely in the past and is necessary.</p>
<p>Crackdown on residents with out-of-state registrations. Many people register their vehicles out of state forgoing payment of Maine State Tax and Excise tax. That is money everyone else has to make up for.</p>
<p>Improve Selectmen and Board meeting notice postings, providing more notice of meetings along with agendas to  residents.  Also improve Bid request and bid results postings and their advance notice as well.</p>
<p>Restart the Department Meetings as they were done some time ago. This provides departmental updates and improves communication between the departments.</p>

<p>Attending &#8211; Selectmen Chairperson Cole, Selectmen Patch and Selectmen Frizzell</p>

<li>Meeting Opened 6:35pm</li>
<li>Heath Road Project &#8211; Project delayed until environmental impact is completed</li>
<li>Tree Cutting &#8211; Residents questioned the tree cutting in West Lebanon and the coincidence<span id="more-3033"></span> that Chairperson Cole had a tree cut as well by the same contractor on the same day.  Concerns were the commingling of Town and private work. Chairman Cole had obtained a separate bill for the tree work but there was contention over the details of the entire project and work performed.</li>
<li>Commercial Hauler Using Transfer Station &#8211; Residents asked status of policy that was to go into effect according to a letter stating it would be done June 1st. Selectmen said they were working on it and would have later in the month. The Selectmen stated that businesses could go into to use facility, then they said they could not. Mr. Patch stated regardless of what is done that Mr. Hartford the Commercial Hauler could use it. It is obvious that the usage of the facility is being and has been selectively applied. As example Sky Dive New England is permitted to use it and they are a business and campground but Flat Rock and other campgrounds are not.  Selectmen Cole stated he sees businesses in there. The residents primary concern is control of where the waste comes from and they felt that all businesses should take their waste directly to the Waste Management and bypass the Lebanon Transfer Station all together.</li>

<p>All Selectmen were in attendance</p>
<p>Meeting Started appx 6:35pm</p>
<ul>
<li>Minutes from previous meeting were accepted</li>
<li>Selectmen Cole read a proclamation for National EMS week, thanking the volunteers for their service.<span id="more-2907"></span></li>
<li>The Mowing Bids received two weeks ago were all rejected. The reason was they were unsure what areas needed to be mowed.</li>
<li>Laura Bragg asked if with the recent staffing changes the locks could be changed on several cabinets in the office to ensure security to records, stickers, and stamps. Selectmen said yes and would contact a locksmith.</li>
<li>Laura Bragg also asked what was to happen next year where the general budget has been set at 32 hours for staff but they will working 40, wont they run out of money? Selectmen Cole explained there was some room to absorb the extra costs and it should be fine.</li>
<li>Glen Stadig asked when the Town Report would be available? Selectmen Cole explained the report needed to be done by the vote and that they were on track to have it before then. It will also be available on the town website via PDF soon.</li>
<li>Glen Stadig asked if vote tally from the Budget Committee would be made available to residents. It was promised at the vote it would provided to the Budget Committee and residents at the town meeting. This has not occurred. Selectmen Cole said he needs to update a couple of the votes that were missed and format the sheet. He was hoping it could make the mailer, but it sounded doubtful.</li>
<li>Glen Stadig asked why a Town Manager was not at the Town Meeting last evening to explain to residents the role a Town Manager performs? At earlier inquiries Selectmen had indicated North Berwick and or Berwick managers would be attending. Selectmen Cole said the meeting lasted 4 hours as it was and that he had trouble connecting with managers at the other towns.</li>
<li>Glen Stadig asked for clarification why the Mowing Bids were rejected? The request was put out only three weeks ago, what has changed so drastically in that amount of time? Selectmen Chairman Frizzell said the rejection was due in part to washouts and ditching that has been done, left many areas without much to mow. Selectmen Cole said Selectmen could not reach a consensus on how to determine what to mow and it might be revisited later.  Selectmen do not want to pay for a mile of road to be paved, when only half needs to be done.</li>
<li>Chris Gilpatrick spoke on the Mowing and said being a contractor if mowing was to be done the lowest bidder should still have the option to accept (this was not Mr. Gilpatrick&#8217;s company). He also said to have it re-bid at this time would not be right since all the bidders who submitted know the others prices. Mr. Gilpatrick stated his concerns this was a means to steer work to the contractor who has done the mowing the last couple years.</li>
<li>The Paving bid was awarded to F.R. Carroll.</li>

<li>Meeting opened at 6:30pm</li>
<li>Minutes approved from last meeting</li>
<li>Articles and materials for the June 8 town vote were signed</li>
<li>Selectmen changed policy last week to allow benefits for employees who work 25 or more hours. This change has been made to the policy but there was question exactly how the revision should be done.</li>
<li>Roadside Mowing bids were opened &#8211; Boucher Construction 160 mile, Russell Howard 140 Mile, Frank &amp; Roxanne Bumford 145 Mile, Jr&#8217;s Trucking and Landscaping 145 mile, Gilpatrick Property Services 148 Mile, C&amp;R Trucking 158 mile. &#8211; The project will be awarded during the 5/18/10 selectmen meeting. Selectmen Cole clarified the cost per mile was for both sides of the road for 1 mile.</li>
<li>Public Participation was had while waiting for 7pm</li>
<li>Laura Bragg asked that a notice be sent to all employees in there checks about political influence. There is a section in the employee handbook that essentially states you can&#8217;t stump for yourself or others during working or use your position for the same. Selectmen thought this was a good idea and will be done.</li>
<li>Glen Stadig asked if the vote roster from the Budget Committee vote would be published. Selectmen Cole said he was missing a couple and needed to watch the video of the meeting to complete.</li>
<li>Chris Gilpatrick asked if Selectmen had responded to his written request for a key to the transfer station from last week. Selectmen had but not mailed the letter and handed it Mr. Gilpatrick directly.</li>
<li>Mr. Torno Sr. asked Selectmen if they expect taxes will increase or decrease? Selectmen Cole explained that there had been reduction in state funding, an increase in school expense, and significant cuts in town budgets with the goal of holding the line. Selectmen Cole expects the tax rate to hold about the same.</li>
<li>Paving Bids were opened &#8211; Dayton Sand &amp; Gravel 70.75 ton, Brocks Industries 86.45 ton 120 hand, Libby Scott 67 ton 120 hand, Pike Industries 76.50 ton, RD Torno 61.45 ton 110 hand, FR Carroll 59 ton 100 hand. The project will be awarded at the next Selectmen Meeting on 5/18/10.</li>
<li>Mr. Torno spoke and asked if Selectmen take into account the distance the hot top is trucked and the temperature of it when laid? He also stated that in the past FR Carroll had charged for a water truck that was on site that was supposed to be part of the contract? Selectmen said they would look into it an make a decision to be announced in a couple weeks. Mr. Torno was upset and explained his disdain for Selectmen Frizzell for not awarding the bid to the lowest bidder (him) in the past and claimed it was because Mr. Frizzell personally didn&#8217;t like him, a claim Mr. Frizzell denied stating he really didn&#8217;t know Mr. Torno.</li>
<li>The Heath Road Culvert Project was awarded to Brown Industrial Group for $59,433 the next closest bid was about $83,000</li>

<p>Meeting Highlights:<span id="more-2838"></span></p>
<p>Selectmen made a change to the Town Personnel Policy to allow benefits to paid to employees that work 25 hours or more. Previously the benefits were provided at 32 hours. This change was made to make allowance for the reduction in hours at the town hall and CEO.</p>
<p>Selectmen signed paperwork for the upcoming school budget and voting. The School budget review will be Thursday May 6th at the Noble High School. All residents are encouraged to attend and participate. This is the meeting that will set the budget that will be voted on by the town on Tuesday May 10th.</p>
<p>Chris Gilpatrick asked if Selectmen had made a decision over his request in November to have a key for the transfer station. He said a key is provided for the commercial hauler to use at anytime and that other residents should be allowed the same opportunity. Mr Gilpatrick has raised this issue at nearly every meeting. Mr. Gilpatrick also requested he receive an answer by next Tuesday and that the Selectmen Response be in writing. Chairperson Frizzell said that he would like to see a written request from Mr. Gilpatrick if he would like a written Selectmen response. Mr Gilpatrick said Selectmen could expect it tomorrow.</p>
<p>Selectmen Cole gave public thanks to the Fire Department for the cleaning of the Town Hall parking area. The department used the high pressure hose to wash off the winter sand that had accumulated. A letter was also sent.</p>
<p>There was some general chatter since there was about 15 minutes of time before the hearing could be opened. It had been publicized for 7pm.</p>
<p>The Hearing was opened for the adoption of the 2005 General Assistance Ordinance as required by the State. The hearing was opened, the ordinance adopted and then closed without objection.</p>

<p>Meeting started approximately 6:35pm and ended at approximately 8:05pm</p>
<ul>
<li>Meeting minutes were approved for past February and March meetings&#8230;</li>
<li>The School Bond Warrant item was signed by Selectmen. This allows the bond issue sponsored by the school department to come before the people for vote. The Bond encompasses several projects in the district towns. The one directly affecting Lebanon is a $235,000 +/- addition to the Hanson School, which would provide an expanded public library with year-round access. The direct cost to Lebanon would be something like $90,000 which is available in a trust fund for the purpose. Complete details will be forthcoming as we get closer to June.</li>
<li>Godeepmud.com came before Selectmen to request renewal for the permit for mass gathering. Godeepmud.com operates a venture for mud racing just of Rt 202 and has several events during the year. Last year was there first year and it was very successful and well received. There were issues with noise, parking and such but these were addressed timely and several improvements have been made to the area where the event is held to improve safety, parking access and parking  capacity.  The permit was granted and their first event will be upcoming in a couple weeks.</li>
<li>A resident came before selectmen to request a Tax Abatement.  After hearing the residents concerns and dilemma, and much discussion to learn the facts the Selectmen ultimately denied the request. They explained how the property was in line with similar properties therefore no change could be made.</li>
<li>Glen Stadig asked if any change has been made to policy at the transfer station to limit the volume of tires being disposed of. He explained over 3200 tires have been brought through the transfer station since September, with half of them being moved during December.  Selectmen stated the dropping of tires in town was a problem and they routinely get picked up. Stadig explained over 48 ton of tires in five months is absurd when other towns have like 75-200 (1-2 ton). There was talk of trying to catch the dumpers, but not much else. over $7500 dollars has been spent this year disposing of the tires not accounting for hauling fees and time to pick-up the tires.</li>
<li>Chris Gilpatrick asked what the intent was of the letter that was sent out by Selectmen to the Budget Committee stating all requests for information must come through the Budget Committee Chairperson. He felt as an elected person he should be able to make simple requests directly instead of going through a set of channels that only add complexity and delay. Selectmen explained it is to prevent duplication of effort and request from several people and is not uncommon when dealing with boards or committees. Request for information have not been a problem, but Selectmen are trying to be proactive.</li>
<li>Chris Gilpatrick also asked the Selectmen the status of the Budgets. They said the General Government Budget would be available to the Budget Committee tomorrow night and that they also had several changed budgets to share.</li>

<p>In Attendance: Selectmen Patch, Selectmen Cole, Selectmen Secretary Sue Collins, Town Clerk Laura Bragg and 4 residents. Meeting lasted roughly 50 minutes. Selectmen Chairperson Bob Frizzell was absent&#8230;no reason provided.</p>
<ul>
<li>A resident came concerned over the changes in Shoreland Zoning. The changes being made are required and will be placed to the people for vote in June. The exact changes are unclear, and the Planning Board has the details. The plan should be available 45 days before vote and the town will try to place information online.</li>
<li>Laura Bragg asked if Selectmen will be having a Town Manager come to speak on the job and role of a Town Manager since the item will be on the ballot. Selectmen said that they had spoken to North Berwick&#8217;s Town Manager Duane Morin and he said he could be available. There was also interest in possibly contacting Berwick as well.</li>
<li>A resident came in concerned about the gate placed on Hebo Hibo Road. Selectmen Cole explained the gate was placed there to keep people out of the area. There has been lots of trouble with partys, fires, mischief and trash. Since the road is subject to gates and bars the Town of Lebanon felt it is the best interest to gate the road. All property owners will be provided keys.</li>
<li>Laura Bragg explained the Town of Lebanon purchases passes for Water Country, Funtown USA, and the movie theaters at a discount rate. These are available to residents and will be advertised on the town site. There was a question on the movie tickets since they needed to be purchased ahead of time.</li>
<li>Laura Bragg wanted to ensure Selectmen understand since the town does referendum voting, the ballot must be finalized by Monday, April 26th to allow the 45 days as required. Selectmen are urged to get all the items together to placed on it early.</li>
<li>Chris Gilpatrick had questions and concerns over having a single Budget for the Roads department versus having a Winter and Summer budget as has always been done. Primarily his issue is the money could be spent leaving no funds to plow, salt, and sand. Selectmen Cole explained the single budget was recommended by the attorney and the town auditor. He also explained how payments are approved by Selectmen and signed off and that spending for each of the department is checked routinely. Selectmen Cole felt there was little to be worried about and that checks and balances were sufficient.</li>
<li>Chris Gilpatrick also raised concerns over the nearly $300,000 remaining in this years winter budget. He wanted to see the money moved forward for next year and not spent. Selectmen Cole said that some roads had received damage with the recent storms and some of that work would likely come from these funds but some should remain.  Heath Road is also a problem and may be done from these funds.</li>
<li>Glen Stadig asked that the policy requiring Budget Committee members paying for financial information be revisited. Just last week when doing research a charge of $5 per department was levied when requesting simple electronic reports from the accounting system. It cost $30&#8230; Mr. Gilpatrick had requested a vendor listing and was charged $28. The same report was later provided to the Budget Committee for free.  Selectmen said that reasonable requests made by those in a Budget Committee role would be provided an exception. They said to contact the Treasurer for a refund.</li>
<li>Glen Stadig also asked that the Selectmen consider sharing the Budget Status reports they look at routinely with residents via the town website.</li>

<li>Minutes from the last several meetings were accepted.</li>
<li>Paperwork for Election Clerks was submitted for signature, Mr Patch would not sign until tomorrow.</li>
<li>A Red Cross Proclamation was read, making March Red Cross month.</li>
<li>The Public Hearing has been set for May, 17, 2010 7pm at the Lebanon Elementary School. This hearing will be to review the items that will be on the on the June 8, 2010 ballot.</li>
<li>Meeting adjourned about 6:43pm.</li>

<p>In Attendance &#8211; Selectmen Chair Bob Frizzell, Selectman Jason Cole, Selectmen Ronal Patch, and Selectmen Secretary Susan Collins. Meeting started 6:30pm and lasted approximately 1:35 minutes<span id="more-2343"></span></p>
<p>Town Clerk Laura Bragg addressed Selectmen and said she had contacted the Maine Municipal Association (MMA) to get information on conflict of interest policies. She placed a packet in each of the Selectmen&#8217;s in boxes for review.</p>
<p>Mrs Bragg also asked if Selectmen wanted copies of reports that are provided to the Budget Committee. Selectmen said they did want to receive copies. She also walked through a time line of dates for Budget Committee voting and Public Hearings. She asked if Selectmen wanted town attorney Alan Shepherd to be moderator, and they did.</p>
<p>Mrs Bragg also stated she was getting guidance from the MMA on how to handle the Charter Commission notices and balloting for June. She also asked Selectmen if the town was building a Library at the Junior High? Selectmen said not at this time details are coming together.</p>
<p>Ray Jerome a resident of Sewell Shores came before Selectmen, inquiring if road improvements could be made to a 270&#8242; portion of road. He provided details and sketches. Chairperson Frizzell speaking on behalf of the board stated that 70k was spent in 2006 on improving the road, and presently there simply isn&#8217;t any funds to do further work.  There are eight residences on the road in question. There was much discussion over the history of the road and a potential land exchange between the Sewell&#8217;s and the town. No action will be taken at this time.</p>
<p>Chris Gilpatrick inquired about the commercial hauler using the transfer station and the prospect of getting a key, which he has done at every meeting since 11/24/09. Selectmen said they would not be addressing the issue at this time since they are busy with the towns budget process which is getting underway. No date was provided to follow-up. Mr. Gilpatrick explained his displeasure with the inaction of the board. Mr. Gilpatrick also asked if anything had come from the plowing/sanding work being done where he pointed out a contractor may have over billed the town. Selectmen said he should see Ray Davis for an answer. Mr. Gilpatrick submitted a request for financial information from 2008 to the Selectmen.</p>
<p>Terrylisa Barrows asked Selectmen if they had any way to manage and track issues brought to them so things don&#8217;t slip through the cracks. Issues like the Sewell Shores road and the many others that have been raised. Chariman Frizzell stated they did not.</p>
<p>A gentlemen representing the Babe Ruth organization spoke before Selectmen indicating Babe Ruth baseball was alive and well. He appeared to be hoping to get support from the Recreation department funds to support the organization.</p>
<p>Glen Stadig addressed Selectmen and raising concerns over the conduct of the Board of Selectmen. The daytime meetings not having minutes, executive session not being initiated properly, improper meeting notices, and the moving of meeting location unannounced.  Chairman Frizzell explained they didn&#8217;t have to keep any minutes not even of the current one (which they do). The moving of today&#8217;s morning meeting was a disconnect with the person who posts the notice. Mr. Stadig said they should not have met without proper notice and that these things must change. He then went through a list of items he brought forward, some going back to June of 2009 that have not been answered or addressed by the board.</p>
<p>Terrylisa Barrows addressed Selectmen asking if the town had a charter for basic rules to follow. She had spoken with a person who worked in the town some years ago and that person said they did have one. She was provided with a copy of the towns charter, which was more of an incorporation document.</p>
<p>Matt Barrows asked if the Sewell road work that has been done and is also being proposed by the residents was on a &#8220;town road&#8221; or &#8220;private road&#8221; selectmen stated the portion work was done was town owned. Mr. Barrows followed up by asking if school buses travel the road. Selectmen said to there knowledge it did not.</p>

<p>Meeting started about 9:05am   Selectmen Patch and Selectmen Chairperson Frizzell present, Selectmen Cole absent.</p>
<p><span id="more-2319"></span>Christine Torno explained troubles that have been ongoing and unresolved when printing from the Trio system. Steve Endsley explained the printer problem that was being experienced is a software issue the software vendor states it is a printer problem. Christine just needs clean, clear reports for the State. Steve is going to look into trading her printer for a different model.</p>
<p>The Phone exchange being 608 causes some residents to pay long distance charges. Fairpoint is being contact to see if there is a solution. According to Mr. Endsley the old town hall numbers could have been forwarded for a small monthly fee. Mr. Randall a Selectmen at the time didn&#8217;t think it would be a good idea so the numbers were changed.</p>
<p>Mr. David White came before Selectmen and asked that the OurVoice website banner at the Transfer Station, be removed from town property. Selectmen explained there was no ordinance and that other town clubs and organizations are allowed. There was some discussion that it might be considered campaigning by Mr. Stadig since there was information indicating a potential candidacy handed out at the November polls. Mr. Chris Gilpatrick spoke and stated he was the one who had placed the banner and had received approval by Selectmen Cole before doing so. Mr. Davis is concerned other signs could get put up there and it would get out of control. Mr. Stadig explained the website is a Community Website with news and events.  Selectmen said they would look into it.</p>
<p>Mr. White also stated that something needed to be done on Shapliegh road to manage the water coming across the road that is freezing. He is concerned about it causing an accident and liability to the town. He also said a culvert near Gully Oven was somewhat blocked with brush that should be removed. Selectmen said they would look into these issues and perhaps discuss with Ray Davis the road commissioner.</p>
<p>Susan Collins the Selectmen Secretary asked what was to be done with the Budget Committee letter response. A formal response would be made back the the Budget Committee in writing. She also brought in an abatement request for Selectmen review.</p>
<p>Mr. Chris Gilpatrick asked if there had been any decision on his request made about the commercial hauler stopping and the Transfer Station keys being made available to residents. There was much discussion on the matter. It has been over a month since Mr. Gilpatrick&#8217;s initial request, but the Selectmen still need to look at things. At issue is the town subsidizing a private enterprise by allowing them to use the transfer station to dump refuse which the town cannot control where it comes from. There is also a liability issue where the company accesses the Transfer Station after hours unsupervised and unfettered. The company could simply take the waste directly to waste management, which might cause a small increase in his pick-up fees to his customers. This would take the town out of the trash pick-up business and stop the majority paying for service that serves a minority.</p>
<p>Mr. Gilpatrick asked about the sanding and salting of the school. The town made a deal to sell salt and sand at a major discount to a company who will be plowing the schools this winter. The company was hired by the School to do the work, but also plows a regular route for the Town. Mr Gilpatrick inquired about the time slips and time submitted, since during the recent storm his son witnessed the trucks starting the school plowing at 4am. The Selectmen reviewed the slips and they showed that the company had submitted their plow time from 3am &#8211; 9am -  6hrs @ $52 hr. There was no gap for the time taken for the school work, which would indicate the town was overcharged. Selectmen were puzzled and would look into it.</p>

<p>Meeting was attended by Selectmen Ronal Patch and Selectmen Jason Cole</p>
<p>Laura Bragg addressed Selectmen and explained the Charter Petition has been certified and that enough signatures have been verified so it will be on the ballot in June. She provided Selectmen formal notice as required and has been in contact with the Town Attorney and the MMA on what steps to take next.</p>
<p>Ms. Bragg requested the Selectmen read and approved the minutes from the last couple meetings. Which they did.</p>
<p>Ms. Bragg asked about the cover of the Town Report..Do Selectmen want this to go out to the kids to draw as we have done in the past? Yes..the Selectmen liked the idea.</p>
<p>Residents Questions:</p>
<p>Glen Stadig asked if anything has been done on providing reports and information to residents by PDF file? This would save paper, toner and time versus printing and cost next to nothing to implement. There was some confusion over the way software works, Glen explained how it operates and the Selectmen will look into it.</p>
<p>Chris Gilpatrick asked if anything had been decided on the keys to the Transfer Station and the commercial hauler? There had been some discussion but nothing has come of it yet. There would be more discussion.</p>
<p>Chris Gilpatrick also asked why the Town Website changed the Selectmen Workshop to Selectmen Meeting? Laura Bragg said she made the change and Selectmen Cole explained that if they needed to sign a pole contract for example they could do this easily during the day versus bore the public doing it at night. Concerns were expressed that other business could be done and would be done without proper public oversight and the daytime meetings do not provide the general public access due to work etc.</p>
<p>Glen Stadig asked about the dirt fill being spread at the lot on route 202. Stadig was going to check with the CEO but asked Selectmen if they new anything about it. He had heard it was hazardous waste that was being relocated in town. Selectmen said they had received several calls with concerns and that the CEO had checked with the State and it was o.k. The dirt may be used as long as the property is not used for certain things like day care etc. This doesn&#8217;t seem to make sense that hazardous waste should be allowed to be used in this manner without any treatment. It could affect abutters wells, pets, and more for what? The dirt is believed to contain oil, acids, and other contaminants from a Junk Yard. It was discussed and Selectmen Cole said he would get the contact the CEO spoke to Mr. Stadig. Selectmen Patch said he understood the dirt was previously on a flood plain and had to be moved. It didn&#8217;t make sense to anyone that the new usage was allowed. The new lot is near residences, and is rather wet and swampy itself so the contaminants could easily spread to run off.</p>

			<content:encoded><![CDATA[<p>I arrived at 8:50 am, and the meeting had already started, so I picked up in process. All Selectmen were present.</p>
<p>Meeting Highlights:<span id="more-2249"></span></p>
<p>Fire Chief Skip Wood was explaining the cost and options for a new Fire Truck to the Selectmen and fielding questions. Much of the discussion focused on the overall cost, finance options such as a bond, and various models of engine and options that would meet Lebanon&#8217;s needs.</p>
<p>One of the problems cited is the need to have good capital improvement account to fund a large expense like and engine and the fact according to Mr. Wood they need an engine now. Numbers varied from $245,000 &#8211; $380,000 depending on options and if they could find a &#8220;demo&#8221; vehicle or not. Selectmen Cole asked about getting a smaller truck like a Ford F550 which could carry several people, a foamer, Jaws of life etc that could be used to quickly respond to accidents, since this accounted for the majority of the call volume. Chairman Frizzell felt the body wouldn&#8217;t last as long as a real engine would. Trade-in and value of the old engine was discussed.</p>
<p>9:21 Ray Davis addressed Selectmen<br />
A resident on Upper Barley requested he place a dead end street sign be placed on the street, is this o.k.? It was discussed and checked with the CEO that yes the Dead End signs could be placed. The road is only passable by off road vehicles and hopefully this would prevent someone from attempt crossing with a regular vehicle.</p>
<p>Mr. Davis also inquired about moving stuff 8am tomorrow, it was confirmed</p>
<p>Mr. Davis explained Sewel Shores residents have been asking about road work. A meeting is scheduled for the 15th. Town has spent 80k on the bottom portion, they want road corner changed. The 300&#8242; of work they want could be an easy 100k estimated cost.  Selectmen felt they had done enough to accommodate the needs and that the monies could be better spent elsewhere. Nothing will be done until the meeting.</p>
<p>Sue Collins Addressed Selectmen regarding a couple residents contesting the Tax Abatement denial. One property was fairly taxed the other will be looked into further. Selectmen Cole is following up.</p>
<p>Brian Rainaud the Code Enforcement Officer addressed Selectmen. They went into executive session for roughly 11 minutes.</p>
<p>Jane Gerrish approached Selectmen and requested permission to contact the towns Attorney Alan Sherphard on a matter of foreclosure. Selectmen said it would be o.k. this time.</p>
<p>Sue Collins Addressed Selectmen regarding the wording for a letter to the department heads on preparing budgets. Do they want it to state no increases in budgets? This needs to be decided quickly so they can be sent, the Department Head meeting is approaching quickly on 12/15.</p>
<p>Ms. Collins also stated she was attending a meeting this week on getting residents the Weatherization kits. She is hoping they are handled like they were last year, but fears they may make things more complicated than necessary.</p>
<p>Ms. Collins also stated that Richard Nass called and recommended build America bonds as well as HLS and FEMA grants for potential sources to finance Fire Truck.</p>
<p>Ms. Collins said at 11:45am tomorrow at the Fire Station a resident who is 106 years old will be recognized.</p>
<p>Ms. Collins has attempted to contact the home health visiting nurse as requested by Selectmen. She has yet to receive a response. Selectmen want to meet with them over clinic.</p>
<p>Ms. Collins asked is Selectmen support having an Auction in spring on foreclosed properties? If so things have to happen fast to have everything ready and allow for proper notice, to have it done before April 1st. The benefit is tax bills can be cut cleanly and it keeps things in order. Selectmen supported this</p>
<p>Selectmen Cole stated the Assistant Animal Control Officer has been laid off</p>
<p>Selectmen Cole had to leave&#8230;</p>
<p>Cindy Arroyo addressed Selectmen &#8211; 18 bags of clothes need to be laundered for clothes pantry. She left momentarily and returned later stating Jim Boucher and Ms Tibia are donating laundry services to cover the expenses.</p>
<p>Ms. Collins provided a proposal from Paul  Andrade about the school for Selectmen to review, she also provided copies of the minutes for Selectmen to review &amp; approve.</p>

<li>It was announced Sen Richard Nass will be at the Lebanon Elementary School Oct 14th 7pm to explain the State Excise Tax referendum and field residents questions.</li>
<li>November Municipal Ballot -  Glen Stadig asked what the status was of the November Municipal Ballot due to an article published in Observer the prior week indicated a potential for the town NOT to have one. This did not agree with the promise of the Selectmen to the Budget Committee to place any essential services items voted down in June back before the people. It also didn&#8217;t make sense because there had been discussion since July at every Selectmen meeting over the Town Manager plan being placed on the November municipal ballot and further discussion over the pending Petitions and their deadline.   Selectmen said it would be decided tonight and discussion ensued.  &#8211; - &#8211; -  In November the town will be having a ballot for the State so the polls and staff need to be set-up and committed, it makes good sense to have a Municipal Ballot at the same time particularly given the anticipated high voter turnout. Chairman Frizzell stated his concerns were financial with the uncertainty of the excise tax looming.  Selectmen Cole speaking as a resident, explained how Lebanon Rescue will save thousands by acting quickly, and how mechanical failures have caused missed calls which not only cost revenue, but more importantly could cost lives.  He further reminded everyone that  not only would the new ambulance generate new revenues, but because it will serve as a back-up it will ensure we are able to maintain the present revenue accustomed to. As a Selectmen, he rallied for the other Selectmen to maintain moral and ethical certainty by having the ballot as promised. How can the Budget Committee or the residents have any faith in the board if we vote not to have a ballot? he explained.  Selectmen Cole and Residents in attendance urged the Selectmen to do the right thing, and let the people have a say. There was lengthy discussion which at times diverged.  Chairman Frizzell eventually asked to see the video of the budget meeting and a recess was taken so he could observe several minutes of video that showed Judy Churchard (Former Chairperson) Selectmen Cole and Himself before the Budget Committee. Selectmen Chairperson Churchard promised the Budget Committee several times &#8220;you have our word, essential services voted down would be revisited&#8221;. This was a key matter in gaining Budget Committee approval. Chairman Frizzell upon returning from the recess and five minutes of silence spoke stating he hoped he was doing the right thing but was voting AGAINST the ballot. Not one of the residents in attendance could understand why and left in dismay and utter disbelief.  Selectmen Patch remained quiet through most of the proceeding,  stated he told voters during his campaign he would not support a special town meeting, even though Selectmen Cole explained a November municipal ballot was NOT a special town meeting. This left the decision squarely on Chairman Frizzell.    There was much discussion which occupies most of the meeting&#8230;I recommend you watch the video to see all the dialogue. &#8212;&#8211; I would like to acknowledge Mr. Coles efforts in trying to encourage and explain to the other Selectmen to do the right thing. In my opinion it was a despicable act that the Selectmen would in the end go back on their word and not have a ballot. Particularly with the arguments and reasons they provided. &#8211; You be judge&#8230;.</li>

			<content:encoded><![CDATA[<p>Meeting Highlights:</p>
<ul>
<li>An offer for real estate tax settlement was approved by selectmen for a trailer in a park.</li>
<li>Minutes for the July 21st meeting were approved..<span id="more-1843"></span></li>
<li>Generator Project spec has been completed and is out for bid, it will be posted in the Fosters, Observer, and both the Town and MMA websites.</li>
<li>Gil Zinck bench is still in-progress the plaque has been picked up but the bench has not.</li>
<li>Excise Tax referendum from the State was discussed. Senator Richard Nass has offered to come and speak on the matter.</li>
<li>Storage Boxes are still being reviewed and materials sorted. This is nearly complete, but there many police records which remain.</li>
<li>Chris Gilpatrick Jr. spoke regarding a matter at the Transfer Station, where he observed people dumping without a permits. There was much confusion and debate leading to a result that the Transfer Station Permits still need improvement and Mr. Gilpatricks character is steadfast. Mr. Patch still contends &#8220;they know&#8221; who is who and everything is o.k..</li>
<li>Selectmen were asked two weeks ago if they had would consider offering  PDF (electronic) reports for printed items out of the towns system. These could be provided to residents for no cost.  No action has been taken but it would be looked into.</li>
<li>Chris Gilpatrick asked Selectmen if they had answers to the list of questions he had two weeks ago. Selectmen stated they had been working on them and had some of the information but not all, some of the preliminary answers were discussed. Mr. Patch said they would mail a formal response to him as soon as it was complete.</li>
<li>Sealed Bids were opened for Sand needed for the upcoming winter season. Interstate Soils (Bob Frizzell&#8217;s company) had the lowest bid at $5.49 a cubic yard. There were only three bidders, this may have been due to the fact the bid wasn&#8217;t posted on the Town Website until 8/24/09 and wasn&#8217;t in the papers until later in the week. The other bids received were William Ranaud Construction $7.45 cubic yard and S.T.S. Construction $7.49 cubic yard.</li>
<li>Mr. Gilpatrick asked if the legal services for the town have gone out for bid? Selectmen said they have not looked into this. Mr. Gilpatrick provided the information from a previous Budget Committee meeting where the Budget Committee was told by Selectmen Chair Judy Churchard it would be going out for bid this year. Mr. Frizzell was also at this Budget Committee meeting. Selectmen said this would be looked into.</li>

			<content:encoded><![CDATA[<p>Highlights of this weeks meeting&#8230;</p>
<ul>
<li>Selectmen Cole Absent (Due to Job/Work Issue)</li>
<li>It has been a full month since the last regular meeting was held. Previous meeting on 8/4/09 was canceled at 4pm of the day without reason.<span id="more-1791"></span></li>
<li>Minutes could not be approved since Mr Frizzell had missed previous meeting and Mr Cole was  absent tonight.</li>
<li>Comprehensive Plan &#8211; Laura Bragg asked that the Selectmen revisit the forming of a committee for a Comprehensive Plan. The Plan is important and is mostly completed from years ago. If they could get a Chairperson and support the effort if could be completed timely if Selectmen would show leadership.  Selectmen said it was a long process, and they would consider.</li>
<li>Late Hours Change &#8211; There were five days for the remaining of the year where the Thursday night late hours would need to be changed from Thursday to an alternate day.</li>
<li>The Tax Rate has been set and will be $.85 less than last year or $13.00. <a title="Tax Rate 2009" href="http://ourvoice.stadig.org/docs/taxrate2009.pdf" target="_blank">(see Selectmen Letter)</a></li>
<li>Generator Project &#8211; Glen Stadig asked what the status was on the Generator Project, Selectmen stated paperwork was due today from Selectmen Cole, the bid is expected to be posted this coming week.</li>
<li>Gil Zinck Memorial Bench &#8211; Glen Stadig asked what the status is, Selectmen stated the plaque is ready to be picked up, bench should be complete in 2 weeks.</li>
<li>Town Information Printing &#8211; It presently costs .50 per page for any town report or list to be printed and or copied. Glen Stadig requested the town provide the option to residents to print to PDF file. This is not only <em>Green</em> saving paper, toner and ink, it should also make access to information free, reducing barriers. The Resident would only need to provide an email for the file to be sent to. The town could also save the file to  resident supplied media such as USB drive or disk, but that raises major security issues for the network, were email would not. The Selectmen will review and report back.</li>
<li>Transfer Station Dirt &#8211; Some 30-50 loads of dirt have been dropped on the left side of the access road to the transfer station. Glen Stadig asked what Project the earth was being moved there for. Selectmen stated the earth was being removed from the Hanson School leach field project and was clean uncontaminated and free.</li>
<li>Open Letter On Police Coverage &#8211; Glen Stadig had sent an Open letter to Selectmen regarding police coverage and wanted to know if any action is being taken. Selectmen are going to look into and report back.</li>
<li>Transfer Station Stickers &#8211; Glen Stadig asked what the status was on the stickers at the transfer station for &#8220;seasonal / non-residents&#8221;.  Last it was discussed several weeks ago this had not been resolved and out of state plates are routinely seen without stickers. Selectmen Patch stated that a card has been issued to those people, and to people who have recently moved into town. These are checked when the people arrive to dump.</li>
<li>Town Manager Referendum &#8211; Glen Stadig requested the Selectmen place the referendum on the ballot since petitions were being circulated, soon to be submitted and it would save the Town Clerk the effort of certifying signatures. &#8211; Selectmen would consider..</li>
<li> Civil War Monument &#8211; Leon Blood and Jon Sewel described a desire to place a monument to the Civil War Veterans on town property. The area in question is the woods adjacent to the Town Hall and the fire pond. The monument would be a large boulder with a bronze plaque containing the names of the roughly 178 persons who fought in the Civil War from Lebanon. Any fill needed, the boulder, and so on would be donated. The Selectmen appeared in favor of the idea and were going to review the exact area after the meeting. During the discussion selectmen spoke of the desire to have a path connect from the Hanson school and a future unspecified building also being behind the Town Hall.</li>
<li>Can The Library Rocks Be Painted?- Jenn Griffin asked if it would be alright to have the kids paint the rocks outside the library as a project and to brighten things up. Selectmen Approved</li>
<li>Library Benches Outside? &#8211; Jenn Griffin asked if she would be allowed to place donated benches outside near the library to be used for reading by residents and recreation department. Selectmen Approved</li>
<li>Library Year-Round Use? &#8211; Jenn Griffin asked what are the problems with year-round use? Selectmen explained that there is not enough insulation and the pipes freeze so there is no facilities. No further word has come from superintendent regarding the co-op arrangement at the Hanson School.</li>
<li>Library Expansion and Clothing Pantry &#8211; Jenn Griffin asked if there could be any consideration to expanding the present library and updating, so it could be used year round and provide a permanent home for a clothing pantry. Selectmen stated they were looking into options with the AM vets in updating the town hall, but is was very preliminary. Using the Town Hall as is was out of the question due to rodent trouble, storage, and heat needs.</li>
<li>Library would Like to Define Walkway and Lot &#8211; Jenn Griffin requested permission to define the walkway and lot so people don&#8217;t block the entrances and cut through the parking area. Selectmen Approved</li>
<li>Shoreland Zoning Maps Error &#8211; Jenn Griffin reported that the State is requiring a change to the Shoreland Zoning maps submitted by the town. A Line on the maps must be &#8220;green&#8221; and isn&#8217;t. The creator of the maps estimates the change to be $200. Selectmen requested the notice be sent to them for review.</li>
<li>Chris Gilpatrick presented Selectmen with a paper that had nine questions requesting an answer and or clarification. These were discussed very briefly and Selectmen said they will be reviewed in detail with answers provided.</li>

<li>How many cutting edges were returned by the town to S.A.McClean?</li>
<li>How much money did the town receive from their return?</li>
<li>Who owns property on Baker Grant Road formerly owned by the Wrights?</li>

<li>Who received the money from the Scrap Metal?</li>
<li>What part of Lords Road was discontinued?</li>
<li>Has the Legal Services for the Town gone out to bid yet?</li>

<ul>
<li>Meeting Minutes Approved from Past Meetings.</li>
<li>Selectmen Chair Bob Frizzell was absent.<span id="more-1644"></span></li>
<li>Appointment papers signed for Eric Nuebert to be Deputy Fire Chief</li>
<li>Sept 29th (Tue) and Sept 30th (Wed) Laura Bragg and Christine Torno will be in Bangor for training. Discussion was had on if and how to keep the Town Hall open in their absense. Concerns were raised over having residents come to the Town Hall and NOT being able to do what they need to.  Options were discussed for cross training or offering limited services but not decision was made.</li>
<li>I asked status of Gil Zink bench. Plaque is being made, then two weeks to put it in a seal it.</li>
<li>I asked if Referendums would be put up before the people for Town Manager, Sheriff, and Comprehensive Plan to allow people to revisit the issues. No  decision was made by Selectmen and they STILL need to discuss. Much discussion was had at this meeting over these issues but no decision was made.</li>
<li>I asked about Generator Project Status. Selectmen Cole stated this should be going out for bid in a week or two once the Spec is finalized and approved.</li>

<ul>
<li>All Selectmen were in attendance.</li>
<li>Pole permits were signed for several electrical poles that were being replaced.</li>
<li>Appointment papers were signed for a couple town positions.<span id="more-1605"></span></li>
<li>Gil Zinck memorial bench is still being reviewed. It is being done but selection needs to be complete selection of style.</li>
<li>Generator Project for Town Hall &#8211; The generator has been sized and quoted by several contractors. Enough preliminary information has been gained to allow preparation of a spec for publishing a public bid request.</li>
<li>Senator Susan Collins will have a representative at the Town Hall, Tuesday August 25th from 9am-12pm. The purpose it to hear residents concerns on issues facing the State. They are making rounds to all towns.</li>
<li>Selectmen Cole explained since the Town would have to have a ballot for the CEO budget re-vote, he wanted to place a referendum on the ballot for the formation of a Town Charter Committee. He explained if the town approves the committee formation in November, the committee members themselves could then be voted into place in June 2010.  Town Clerk Laura Bragg added this is a long process.</li>
<li>I asked if the Selectmen would consider placing Town Administrator, and Sheriff Deputy referendums back onto the ballot in November.  Selectmen stated they need to discuss and review. I asked that they provide an answer at the next meeting so that residents may be allowed time to circulate petitions if necessary.</li>
<li>Go Deep Mud.com appeared before the Selectmen to request approval for a mass gathering permit. They will be having  races the last Sunday of the month this July, August and September in town. They explained it was a family affair and great fun. The Selectmen unanimously approved the request. <li>Selectmen Cole made a motion to continue to maintain Bog Road including plowing and salting as has always been done, since it was unclear through investigations with the Town, County and State the intentions of the residents in 1939. This motion passed 2-1.</li>
<li>Keay Road is being worked on, work started yesterday, rocks were removed from the road, ditching was done, and trees were cut back. Monies remaining from June 08/09 year are being used used for this purpose.</li>
<li>The Records Storage Shed has been placed on hold for the time being. The records will be removed from the current shed and placed at the Firehouse. During the move Town Clerk Laura Bragg is organizing and sorting them out. The old desks are being tossed out at the Transfer Station.</li>
<li>It was asked why Town mowing did not go out for bid? It would seem the mowing of the Town Hall, Intersections and Islands has been awarded without bid. Concerns over liability if a rocks a thrown into vehicles and liability for personal injury were raised. Selectmen said this would be looked into.</li>
<li>It was asked why the Roadside Mowing was not being done as specified. A resident explained how long sections of the road were only done 2-4 feet from the edge of the pavement not the 6-10 feet as required. You can view examples of this on lower guinea which was cut today.</li>
